Terms & Conditions

Welcome to Dearest Digital™. By accessing our website, uploading files, or using any of our digital organization services, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

1. Content Ownership & Copyright

You retain 100% ownership of all files submitted to Dearest Digital™. By uploading files or sharing access to cloud storage, you confirm that you own the content or have the necessary permission to provide it to us for organization. Dearest Digital™ treats your files as private and confidential and will not use, share, publish, or display your photos or videos without your prior written consent.

2. Client Backups & Data Security

Before uploading or sharing any files, you are responsible for maintaining your own original backup. Dearest Digital™ uses professional systems and reasonable security measures when handling client files; however, digital transfers and storage can be affected by circumstances outside our control. Dearest Digital™ is not liable for corruption, loss, or interruption caused by cloud-service errors, internet or transfer failures, or unexpected hardware failure outside our reasonable control.

3. Client Cooperation & Project Scheduling

To keep your project on schedule, you agree to upload your files or provide the required cloud access in a timely manner and to let us know when your upload is complete. Delayed or incomplete uploads may require your project to be moved to the next available intake slot. Project timing may also change if the quantity or condition of the files differs materially from the information available when the project was quoted.

4. Organization, Dates & File Information

Dearest Digital™ organizes files using the information available within the files and the material provided by the client. Photo and video dates can be altered or lost through messaging apps, social media, downloads, cloud exports, editing, or device transfers. Where reliable original date information is unavailable, Dearest Digital™ may use the best available clues to place or estimate a file's date. We cannot guarantee that every photo or video will have its exact original capture date.

5. Duplicate Review & Existing Files

Duplicate identification is based on the files supplied for the project and the tools used during the organization process. Dearest Digital™ does not intentionally delete client content without permission. Where duplicates or files requiring review are separated, the client remains responsible for deciding what should ultimately be retained or deleted.

6. Sensitive, Explicit or Prohibited Content

Clients are responsible for the content they submit. If sexually explicit, graphic, illegal, or otherwise inappropriate material is encountered during the organization process, Dearest Digital™ reserves the right, at its discretion, not to open, review, organize, rename, categorize, or otherwise process those files. Dearest Digital™ also reserves the right to suspend or discontinue a project if the nature or volume of the content makes it inappropriate for us to continue providing the service. Content that is reasonably suspected to be unlawful will not be knowingly processed.

7. Revisions

Once access to your completed organized library has been provided, you have 7 days to review the folder structure and request reasonable adjustments relating to the agreed organization service. Requests that materially change the original scope of the project may require a separate quote.

8. Download, Retention & Client Responsibility

Final download links are provided for a limited period, as communicated at delivery. You are responsible for downloading your completed library within that period and for maintaining your own backups after delivery. Dearest Digital™ may retain a temporary working or backup copy for a limited period after project completion for delivery and support purposes, after which it may be permanently removed from our systems.

9. Fees, Payment, Cancellations & Refunds

Fees are based on the package or scope confirmed for your project. Work begins once the required payment and project confirmation have been received. Cancellations and refunds are handled in accordance with the Dearest Digital™ Refund & Cancellation Policy in effect at the time of your booking.

10. Service Scope

Dearest Digital™ provides digital photo and video organization services. We do not guarantee recovery of missing, deleted, corrupted, or inaccessible files, and we do not guarantee that every item can be identified, dated, or categorized. Any work outside the agreed project scope will only be undertaken if separately agreed.

11. Changes to These Terms

Dearest Digital™ may update these Terms & Conditions from time to time as our services develop. The version applicable to your project will be the version in effect when you confirm your project, unless a change is required by law.
